New Report From the FBI Reveals Gun Alec Baldwin Was Holding When Halyna Hutchins Died Was ‘Intact and Functional’

The FBI’s forensic report following the investigation into the shooting on the set of Alec Baldwin’s movie ‘Rust’ has been released. And Alec Baldwin’s attorney is sharing that the report, obtained by ABC News, is being “misconstrued.”

As Mamas Uncut previously reported, Alec Baldwin, while holding a prop gun believed to be empty, shot and killed Halyna Hutchins back in October 2021. As reports suggest at the time, Baldwin was holding the gun and going over the scene they were about to shoot as the camera crew set up the proper angles for the shot. Baldwin, Hutchins, and the director, Joel Souza, were discussing how Baldwin was going to point the gun at the camera when the gun went off.

It was reported that no one knew there was a live round in the gun. This is because the assistant director David Halls announced to the set that the gun was “cold,” an industry term used to assure the cast and crew that the prop gun is safe to use on set.

Now, it is being reported that the FBI found that the gun was “intact and functional.” Further, the report reveals that the gun “could not be made to fire without a pull of the trigger” unless the hammer of the revolver was “decocked on on a loaded chamber.”

Back in December, Alec Baldwin did an interview with ABC News. During that interview, Baldwin said that “the trigger wasn’t pulled. I didn’t pull the trigger. I would never point a gun at someone and pull the trigger on them, never.”

While Baldwin himself has yet to make a personal statement regarding the FBI’s findings, an attorney for the actor, Luke Nikas, did issue a statement to ABC News. The lawyer said the report is “being misconstrued,” adding that, “the gun fired in testing only one time — without having to pull the trigger — when the hammer was pulled back and the gun broke in two different places. The FBI was unable to fire the gun in any prior test, even when pulling the trigger because it was in such poor condition.”

Nikas continued by saying “the critical report is the one from the medical examiner, who concluded that this was a tragic accident.” As ABC News also obtain, the postmortem report revealed that “based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as an accident.”

“This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was ‘cold,’ and believed the gun was safe,” Nikas concluded.

Currently, Santa Fe County Sheriff’s detectives are still investigating Alec Baldwin’s phone records. On August 2, the detectives said “those records are forthcoming.”
