Update: Josh Duggar has been granted bail and will be released from jail as he awaits his trial after being charged for receiving and possessing child pornography in July.
The 33-year-old father of almost seven will be released on May 5 to designated third-party custodians, Lacount and Maria Reber. They had been described as “close friends” of the Duggar family. He will be monitored with GPS tracking and not allowed to visit his own home, wife, or children. Judge Christy Comstock said she “cannot in good conscience” release Duggar to his wife and six children.
On May 5, Josh Duggar was awaiting a detention hearing to see if a judge would allow him to post bail after he was arrested and charged with receiving and possession of child pornography on April 30.
However, prior to his detention hearing, Duggar, who is 33 years old and is the father of six children with a seventh on the way, and his legal team filed a motion to be released on bond. Within that motion, Josh asked for permission to see his wife and children.
As Mamas Uncut previously reported, after Duggar pleaded not guilty to the two charges against him, U.S. Chief Magistrate Judge Erin L. Wiedemann told the father that if he was granted bail he would be required to “have a third-party custodian” and that “the residence where he would stay must be devoid of minor children.”

“Given the nature of the charges against him, the court would likely require a third-party custodian that he could reside with and that would ensure compliance with conditions of bond so you all would need to get that line out and inform our probation office of who that person is so they could interview that person,” Judge Wiedemann said during Duggar’s first court hearing, according to Fox News.
However, prior to his detention hearing, court documents obtained by Us Weekly, Duggar’s legal team is obviously fighting for bail.
“Duggar … has no criminal convictions and has known about this federal criminal investigation since November 2019 when Homeland Security Investigations (‘HSI’) executed a search of Duggar’s prior workplace,” documents obtained by Us Weekly on Tuesday, May 4, state.
The statement continued adding that has reminded compliant when asked to “voluntarily self-surrender” and that he “is neither a risk of flight nor a danger to the community” if he is released on bail.
Given that he has six children and his wife of 13 years, Anna, is currently pregnant with their seventh, Duggar would not be allowed home. And with much of his family raising kids of their own, the question is where would Duggar go?
Well, it seems like his legal team pushed back on that as well. They asked the court to “permit him to return home to his immediate family” ahead of his July trial.
