According to reports, Illinois Appellate Court granted Smollett’s release from jail pending the appeal of his 150-day sentence that was handed down last Thursday. People reports that Smollett will also have to post a $150,000 recognizance bond.

The decision to allow Smollett to be released on bond was granted because “the defendant has been convicted on non-violent offenses” and because the court “will be unable to dispose of the instant appeal before the defendant would have served his entire sentence of incarceration.”

As Mamas Uncut previously report, Smollett was sentenced after he was found guilty of filing a false police report, claiming that he was a victim of a hate crime in January 2019. Smollett claimed he was attacked by homophobic racists, but the jury agreed with the prosecution that the actor paid two brothers he used to work with and created the hoax.

Smollett told police his attackers threw bleach on him and even tied a noose around his neck. During the trial, prosecutors said, Smollett “exploited tense race relations for his own gain and paid the Osundairos [brothers] $3,500 to stage the attack so he could get attention.”

During his sentencing hearing, Smollett addressed the judge and the courtroom.

In his statement, the Empire actor issued a warning. “Your honor, I respect you and I respect the jury, but I did not do this,” the actor told the judge, before turning to the court. “And I am not suicidal. And if anything happens to me when I go in there, I did not do it to myself. And you must all know that.”

A few days later, Smollett’s brother revealed that Jussie had been admitted into the psych ward at Cook County Jail via a video shared on Jussie’s Instagram account. Jocqui Smollett said, “So Jussie is currently in a psych ward at the Cook County Jail. What’s very concerning is that there was a note attached to his paperwork today saying that he’s at risk of self-harm.”

Smollett has maintained his innocence for the last three years.
