No Charges Filed For South Carolina Twin Boys Death: A ‘Tragic Mistake’

The Richland County Sheriff Leon Lott revealed how no charges will be filed against a father in the deaths of his twin boys small children, calling it a “tragic accident.”

Lott held a news conference Tuesday morning where he updated the investigation into the deaths of 20-month-old twins Brycen and Brayden McDaniel. The two were found dead inside an SUV outside a daycare in Blythewood on September 1. Both were pronounced dead at the scene.

Lott admitted it was one of the saddest he’s seen in his law enforcement career. 

“One of the ones that just ripped the community,” Lott said. “It was hard for all of the people involved in this case.” 

Richland County Coroner Naida Rutherford reveal that the boys were probably left in a car for 9 1/2 hours before EMS was called. She revealed that Tuesday’s temperature in the car likely got up to 120 degrees, and has officially ruled their causes of death as hyperthermia, or excessive heat. 

Lott said during the investigation they explored every avenue, and presented their findings to the solicitor’s office, who decided on charges. Ultimately, prosecutors reached the same conclusion about the boys: the father made a tragic mistake, and no charges would be necessary.

The father allegedly had been under intense pressure at work, and his “mind had been somewhere else” that day.

Lott also revealed how the father believed he’d dropped the boy’s off at the daycare.

Hours later he drove to the daycare to pick them up, but they’d been inside the SUV the whole time. He didn’t realize what happened until he went into the daycare to talk to the staff and pick up his children.  

“One of the most heart-wrenching interviews,” Lott said of the interrogation of the father. “Pure emotion came out. It’s not something you could fake.”

“I just ask people to pray,” he said. “Just pray for this family. This family needs prayer…nothing’s going to [replace] these boys, nothing’s going to take away the pain.” 

“This is something that would get you,” he said. “It’s tragic. It’s a parent’s worst nightmare, also a community’s worst nightmare.” 

The children were first placed in the SUV in their rear-facing child seats between 7:30 and 8 a.m. on Wednesday, and the SUV came back to the facility, where the children were found, at 5:30 p.m.  

Rutherford shared how the window to the car had been broken after the vehicle arrived at the daycare, but by the time it was, the children were already dead.
