Zachery Ty Bryan is no longer in police custody following his arrest on July 28. He was charged with assault in the fourth degree APA (Abuse Prevention Act), robbery in the third degree, and harassment stemming from an alleged physical altercation he had with a woman earlier that day in Eugene, Oregon.
Exact details of the incident have yet to be released and it’s unclear who he was fighting with prior to the arrest. He spent six days in jail before his release on Thursday (August 3) and, while this is his second such offense in the past 3 years, his lawyer, John Kolego, is asking the public not to rush to judgment.
“Presumption of innocence is extremely important and people should withhold judgement until they see what the actual facts are,” Kolego said in a statement, according to PEOPLE. As of today, all we can report is that his next scheduled court date is September 5, at which point the public will learn more.

TMZ was the first to report the arrest on July 30 and was followed by a statement from the Eugene Police Department, who confirmed the arrest and vaguely described what went down a few days prior. According to the statement, Zachery Ty Bryan was arrested at around 6:00 p.m. after an altercation with a female.
The altercation allegedly happened several hours prior to his arrest at a residence in north Eugene. Bryan wasn’t at the residence when police arrived, but was contacted by police and they eventually tracked him down before arresting him and booking him for a ‘felony assault in violation of the Abuse Prevention Act.
This isn’t Bryan’s first run-in with the law. In 2020, he was arrested and charged with felony strangulation, fourth-degree assault, coercion, menacing, harassment, and interference – all stemming from an incident with his then-girlfriend, now-fiance Johnnie Faye. The couple were arguing about his past marriage.
Four of those charges were dropped and he was found guilty of two misdemeanor offenses for assault and menacing. The arrest came just one month after he was arrested for his fourth DUI since 2004 – which resulted in him being sentenced to five years probation and 18 months in an alcohol program.
Fiance Defends Zachery Ty Bryan Amid Allegations
In November 2021 – roughly one year after his arrest in 2020 – Zachery Ty Bryan proposed to Johnnie Faye (the woman who he allegedly strangled in 2020) and they’ve welcomed three children together ever since – including a daughter, Kennedy, in April 2022 and twins, Parker and Sequoia, in May 2023.
Several days after his most recent arrest for domestic violence, Johnnie Faye released a statement – which was exclusively published by Us Weekly on August 1 – and spoke out in defense of her fiance. In the statement, she claimed that she will ‘always want what’s best for the father of [her] children.’
“Trauma can bring struggles in many shapes and forms. It’s a horrible situation that’s going to be spun in so many ways,” she wrote – describing it as a ‘horrible situation that’s going to be spun in so many ways.’ It’s a similar sentiment that Bryan shared about his first arrest that allegedly got ‘blown out of poportion.’
