Lori Loughlin and husband, Mossimo Giannulli, were denied their bid to throw out charges in the Operation Varsity Blues case per court documents obtained by Variety.
Just last month, the pair filed a motion to dismiss all of the charges – claiming that government agents engaged in misconduct by coaching the scam’s ring leader, William Singer, to “bend the truth” in recorded conversations to implicated the couple and other families for their alleged involvement.
But on Friday, Judge Nathaniel Gorton ruled that there was no evidence to suggest that the agents engaged in misconduct.
“After consideration of the extensive briefing, affidavits and other information provided by the government and defendants,” Gorton ruled, “the Court is satisfied that the government has not lied to or misled the Court.”
The couple’s trial continues to be set in Boston this fall.
A source tells ET that “Lori is convinced she did nothing wrong and wasn’t expecting the judge to side against her.”
“The ruling made Lori nervous,” the source notes.
“Despite her set back, she has no plans to back down from her nonguilty plea. She strongly believes that [bribery scam ring-leader Rick] Singer misrepresented himself and, because she thought he’d acted on behalf of the school, she feels she is innocent.”
The source adds that Loughlin “never in her life thought that she would ever be in this position, and it’s almost like a bad dream she can’t wake up from.”
“Lori is determined to prove her innocence and she won’t back down.”
